Welcome to the Creative Hubs Grant Program Terms and Conditions.

Please read these terms and conditions carefully before applying for a grant (“a Grant”) under the Emerging Creative Hubs Program (“the Program”). By submitting the application you (“you” or “the Applicant”) confirm that you accept these terms of use and that you agree to comply with them.

About these Terms and Conditions
This page (together with the documents referred to in it) sets out the terms and conditions (“Terms”) on which you apply for a Grant. WeTransfer can amend these Terms from time to time, which will become effective upon them being posted on WeTransfer’s website(s) or at such later date as may be stated on the amended Terms. Therefore, we recommend that you review the Terms from time to time and take note of any changes.

Other applicable terms
These Terms refer to the following additional documents, which also apply to your application:

  • Our Privacy and Cookie Statement, which sets out the terms if, and how any personal data collected from you will be processed; and
  • Your application form, as referred to in article 4 of these Terms.

Information about us
The Program is an initiative from WeTransfer Corporation (“WeTransfer”), which is a subsidiary of WeTransfer B.V., established in Amsterdam, the Netherlands. The Program was created to foster and support creativity by supporting creative nonprofit organizations in ten cities from WeTransfer’s Emerging Creative Hubs index.

In order to be considered for a Grant, you must meet the following requirements:

(a) You are a nonprofit organization

This means that your nonprofit organization seeks to support creativity and culture and your headquarters/main office is located in one of the following cites:

  • Atlanta, GA
  • Madison, WI
  • Norfolk, VA
  • Boston, MA
  • Denver, CO
  • Honolulu, HI
  • San Antonio, TX
  • Salt Lake City, UT
  • Nashville, TN
  • Memphis TN

(b) Your nonprofit organization has at least one full-time employee

(c) You’ve been in operation for more than one year from the application deadline

(d) You can identify a specific event, activity, or project that you will use the Grant for by February 1st, 2024

(e) You can demonstrate how your nonprofit supports underrepresented groups in the creative industries

Application for a Grant is free of charge.WeTransfer shall determine, in its sole discretion, whether your application meets the requirements as listed above. WeTransfer’s decisions regarding eligibility and all other aspects of the Program are final and binding.

If at any stage in the program, it becomes clear that you do not or no longer meet these requirements, WeTransfer may disqualify you with immediate effect and may claim immediate repayment of any Grant paid.

WeTransfer, and any entities that are partially or fully owned and/ or controlled and/ or represented by people that are employed by WeTransfer at the date of application, or that have been employed by WeTransfer less than a year before the date of application are not eligible to apply for a Grant. This also applies to contractors that have provided services or goods to WeTransfer, during the term of the application process or during 1 year prior to the start of the application process.

The entire application process (“the Process”) for a Grant begins on May 10, 2022 an ends on July 19, 2022 (on which all winners of a Grant will be announced). The Process consists of three (3) periods as set forth below:

(1) Submission Period

Start Date (at 12 AM ET) - May 10, 2022
End Date (at 12 PM ET) - June 7, 2022

(2) Initial Review Period

Start Date (at 12 AM ET) - June 8, 2022
End Date (at 12 AM ET) - June 17, 2022

(3) Judging Period

Start Date (at 12 AM ET) - June 20, 2022
End Date (at 12 AM ET) - July 1, 2022

The Submission Period entails the online submission by you via the Program website starting on May 10, 2022. The deadline to submit is June 7, 2022.

During the Initial Review Period, the Applicants that meet the key criteria will be reviewed and additional information may be requested during this time.

The Judging Period runs from June 20 until July 1. Applicants with the most potential will be selected, pursuant to the selection criteria specified below. The selection will be made by a group of WeTransfer employees and a panel of judges, appointed by and on behalf of WeTransfer (‘the Judges”). During this period the WeTransfer Judges will select 10 Applicants who will receive a Grant.

The selection criteria consists of:

  • Clarity of a desired event or project and evidence of community impact
  • A clear and realistic timeline and budget to complete such event or project
  • Clearly identify a community whose needs are not being met, as well as your nonprofit organization’s role, tools, or resources that directly address that need.

There will be up to twenty (20) Grant recipients, with Grants ranging from $5,000 to $10,000.

You commit to spend the full Grant within 18 month from receipt on your idea, event or project specified in your application. If challenges arise to complete the project, you will inform WeTransfer during the process.

In order to apply for a Grant, you are required to fulfill the following, all before June 7, 2022:

(a) Complete the application form, which can be found here; and

(b) A copy of the nonprofit organization’s registration document or profit and loss statement.

All applications are subject to approval by WeTranfer and in WeTransfer’s sole discretion. All Applicants will receive a confirmation email upon full completion of the application form and receipt of the relevant registration document. Entries are subject to disqualification at any time. Each Applicant is limited to one application; duplicate entries will be removed and the most recent entry of the Applicant will be kept.

Applicants may give confidential information or material and/or business secrets at their disposal. WeTransfer does not solicit or wish to receive such information. Any information or material submitted by the Applicant will be deemed not to be confidential or a business secret. You acknowledge that any consequence of the non-adherence of this clause by you is entirely for your own account. WeTransfer specifically disclaims any liability or obligation with respect to information or material provided by you in connection with the Grant application.

The information and materials provided by you for the purpose and in the context of the Grant application, may be protected by intellectual property rights, such as copyrights and trademarks, and may include individuals’ names, photographs, voice, and other likeness.

By submitting your application, you grant WeTransfer a sub-licensable and royalty-free license to use Your nonprofit organization’s name and logo and all information and materials submitted by you in connection with the Grant application in any manner or media throughout the world and in perpetuity, for the promotion of, and any other communications about the Program by WeTransfer on WeTransfer.com, on its social channels, and in any other external publications (such as impact reports and corporate social responsibility contributions).

The granting of this license by the Applicant is conditional upon the Applicant having won a Grant. Without prior approval of WeTransfer, Applicants are not entitled to associate with WeTransfer in any way.

In the event you have won a Grant, you may waive your right to receive the Grant; however, a Grant is non-assignable and non-transferable. WeTransfer reserves the right, in its sole discretion, to substitute a prize of equal or greater value if the Grant, for any reason whatsoever, becomes unavailable. Grant conditions may be added or modified by WeTransfer in its sole discretion.

Payment of federal, state and local taxes and fees due, if any, are the sole responsibility of the Applicant.

The Grant will be paid directly to the relevant Applicant via wire transfer within 30 business days from July 19th, 2022.

Upon WeTransfer’s request, the Applicant shall provide the following information after having received and used the Grant, and up to three years thereafter:

  • A brief update and projector event plan shared at least one month before the beginning of the event or project specified in the grant application;
  • An event or project report shared no later than three months after the completion of the event or project showing the impact of the non profit organization, both before and after the receipt and use of the Grant. The report should also include details about the ways in which the Grant was used and for which purposes.

Such information may be used by WeTransfer in public-facing articles, a public-facing impact report relating to the Program, in statistics and data relating to the Program, and in WeTransfer’s corporate social responsibility contributions.

By applying for a Grant, each Applicant releases and holds WeTransfer, its parent and affiliate companies and each of their employees, harmless from and against any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the application for, and with the acceptance and use of any Grant.

WeTransfer is not responsible or liable for any outcomes of a Grant application and for incorrect or inaccurate information, whether caused by technical or human error or otherwise which may occur in the Grant application process.

If for any reason whatsoever, WeTransfer is limited, in any way, to carry out, or continue with the Program as set out in these Terms, WeTransfer is entitled to cancel, terminate, modify or suspend the Program at any time.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without giving effect to principles of conflict of laws.
